1. Introduction

By using the gatewayvpn.io website and all its related products i.e iOS & Android Apps (the “Services”), you agree to be bound by the following terms of service (the “Terms”). These Terms cover all present and future features provided by your Account. The Services are operated by Gateway VPN (“We”, the “Company”), located at Singapore. Use of your Account or the Services includes registering an Account, keeping an Account open (not deleted by you or not deleted or deactivated by Proton), or accessing our website or mobile/desktop applications, or making use of our services. Please read these Terms carefully before you use your Account or the Services. By using your Account or the Services, you are agreeing to be bound by these Terms. You may not use your Account or the Services if you do not agree to these Terms. These Terms apply every time you use your Account or the Services.

The Company reserves the right to revise these Terms of Service as and when needed. Hence, it is always recommended to review the Terms of Services before using the Services. If you continue using the Services after changes become effective, it will be construed that you agree to the new Terms. If you don’t agree to the new Terms, you must stop using the Services. If we do not hear from you within ten days, then the revised Terms will apply to you.

2. You Agree to

By using our Services, you are agreeing to these Terms and Conditions. Please read them carefully as they constitute the Terms and Conditions of a legally binding agreement between you and the company.

When you agree to use our Services, Virtual Private Network (“VPN”), which includes, but is not limited to, the use of our servers, routers, IP addresses, protocols, add-ons, software, applications and other equipment, you authorize us to transmit information using our network, and you agree to accept the Terms with respect to your use of our VPN Services.

Using our Services, even after any change in Terms, will mean that you agree to these Terms. If you don’t feel comfortable with agreeing to these Terms as they are, please stop using our Services, although we’ll be sorry to see you go.

3. Our Services

Services Fees Use of the Website is free; however, some aspects of the Services may be limited to Users paying with Service Fees, being available at all times on the Website as well as at the point of sale. Access to the Services shall be charged the applicable Service Fee, with said Fee to be charged automatically at the time of creation of account, and then according to the “Billing Cycle” from the payment account provided to us upon Account creation, as updated from time-to-time.

4. Cancellation And Refund Policy

4.1. Subscription Cancellation

You have a right to cancel your Subscription at any time but you may not get refund.

3.2. Refunds

Payments made are not refunded either services are fully used or not used.

4. Prohibited Uses

To protect our Services from being misused, abused or being used to harm someone, we have made some rules which apply to every user equally.

  1. Disrupting the Company's networks and Servers in your use of the Services.

  2. Accessing/sharing/downloading/uploading illegal content, including but not limited to Child Sexual Abuse Material (CSAM) or content related to CSAM.

  3. Infringing upon or violating the intellectual property rights of the Company or a third party.

  4. Harassing, abusing, insulting, harming, defaming, slandering, disparaging, intimidating or discriminating against someone based on gender, sexual orientation, religion, ethnicity, race, age, nationality or disability.

  5. Promoting illegal activities or providing instructional information to other parties to commit illegal activities.

  6. Engaging in spam activities, which are defined as the practice of sending irrelevant or unsolicited messages or content over the internet, typically to a large number of recipients, notably for the purposes of advertising, phishing, or spreading malware or viruses.

  7. Sending junk mail, bulk emails, or mailing list emails that contain persons that have not specifically agreed to be included on that list. You agree not to use the Services to store or share content that violates the law or the rights of a third party.

  8. Abusive registrations of email aliases for third-party services.

  9. Attempting to access, probe, or connect to computing devices without proper authorization.

5. Company Rights

    As a company we reserve the rights to:

  1. To deny service, if you are found in violation of our Terms or Services in any way, shape or form, then we might have to take the extreme step of terminating your Account with us, although we’ll be sorry to see you go.

  2. To modify, add to, suspend or delete these Terms of Service or other agreements, in whole or in part, at our sole discretion at any time.

  3. To introduce new charges, fees or other conditions for use of the Service or parts thereof at any time.

  4. To ask you to verify yourself for any reason at any time at our sole discretion. In case you fail to provide sufficient proof of your identity, as requested by us, your Account shall be terminated and no refund shall be applicable.

  5. To deny you service either it is paid or free to ensure the security of copmany and prevent unauthorized usage of our service.

6. Disclaimer Of Warranties

  1. Reasonable efforts are taken to improve the accuracy and integrity of the Services, but complex software is never wholly free from defects, errors, and bugs. We give no warranty or representation that the Services will be wholly free from defects, errors, and bugs, such as downtime, loss of data, corrupt data, service delay, mistakes, out-of-date information, or other. Notwithstanding any other provision of the Terms, we reserve the right to modify, suspend, or terminate access to the Services, or any functionality comprising a part of the Services at any time. In no event, to the extent permitted under applicable law, will we be liable for making these changes. In exceptional and very limited cases, our Services may be unavailable from time to time due to human, digital, mechanical, telecommunication, software, and other failures. We cannot predict or control when such downtime may occur and cannot control the duration of such downtime.

  2. THE SERVICES AND WEBSITES ARE PROVIDED “AS IS” AND WITH ALL FAULTS. WE MAKE NO REPRESENTATION OR WARRANTY WHATSOEVER REGARDING THE COMPLETENESS, ACCURACY, ADEQUACY, SUITABILITY, FUNCTIONALITY, AVAILABILITY, OR OPERATION OF THE SERVICES. YOU ACKNOWLEDGE THAT WE DO NOT HAVE CONTROL OVER YOUR USE OF THE SERVICES, AND WE DO NOT WARRANT THE PERFORMANCE OR RESULTS THAT MAY BE OBTAINED THROUGH YOUR USE OF THE SERVICES. YOU ASSUME ALL RISKS AND RESPONSIBILITY FOR YOUR USE OF THE SERVICES AND FOR ANY LOSS OF OR ERRORS IN ANY DATA OR INFORMATION. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING THROUGH COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE. WITHOUT LIMITING THE FOREGOING, WE NEITHER WARRANT NOR REPRESENT THAT YOUR USE OF THE SERVICES WILL NOT INFRINGE THE RIGHTS OF ANY THIRD PARTIES, NOR THAT THE SERVICES WILL BE AVAILABLE FOR YOUR ACCESS OR USE, NOR THAT OPERATION OF THE SERVICES WILL BE ERROR-FREE OR UNINTERRUPTED. PLEASE NOTE THAT SOME JURISDICTIONS MAY NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. IN ADDITION, YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM ONE JURISDICTION TO ANOTHER JURISDICTION.

7. Limitation Of Liabilities

  1. There are inherent risks in relying upon, using, transmitting, or retrieving any data and/or content on the internet, and we urge you to make sure you understand these risks before using the Services. Gateway VPN disclaims all responsibility for the behavior of its users and/or visitors when they access or use the Services/Websites.

  2. YOUR USE OF THE SERVICES AND WEBSITES IS AT YOUR OWN RISK. NEITHER Gateway VPN, NOR ANY OF ITS PARENTS, SUBSIDIARIES OR AFFILIATES, NOR ANY OF THEIR EMPLOYEES, OFFICERS OR DIRECTORS, SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR OTHER DAMAGES (INCLUDING, WITHOUT LIMITATION, LOSS OF DATA OR INFORMATION OF ANY KIND, LOSS OF BUSINESS, LOST PROFITS, INTERRUPTION OF BUSINESS, COST OF COVER OR ANY OTHER DAMAGES) ARISING OUT OF OR IN ANY WAY RELATED TO THESE TERMS OR THE USE OR INABILITY TO USE THE SERVICES OR WEBSITES, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE, THE TOTAL AGGREGATE LIABILITY OF Gateway VPN ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED WHAT YOU PAID TO Gateway VPN DURING TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO SUCH LIABILITY AND SHALL NOT INCLUDE ATTORNEY FEES OR COURT COSTS IRRESPECTIVE OF ANY LAWS OR STATUTES THAT MAY PRESCRIBE OTHERWISE. YOU ACKNOWLEDGE THAT THE AMOUNT OF FEES PAYABLE BY YOU TO Gateway VPN HEREUNDER REFLECT THE ALLOCATION OF RISK SET FORTH IN THE TERMS AND THAT Gateway VPN WOULD NOT HAVE ENTERED INTO THE AGREEMENT WITH YOU WITHOUT THE LIMITATIONS ON ITS LIABILITY CONTAINED IN THIS SECTION.

  3. Some jurisdictions restrict or do not allow the limitation of liability in contracts (e.g., limitation of liability for death or personal injury caused by other party's negligence, fraud, or fraudulent misrepresentation, willful misconduct, or gross negligence). As a result, respective provisions of this Section may not apply to you. In cases where such restrictions on the limitation of liability apply, the liability of Gateway VPN shall be limited to the fullest extent permitted by certain applicable law.

  4. Please also note, that Gateway VPN has implemented security measures aimed at securing the Services and Websites; nevertheless, the internet is not a secure network and system reliability could be impaired independently of Gateway VPN's efforts and will. In addition, Gateway VPN cannot be held liable for unpredictable events such as cyber attacks, security breaches regarding the transmission of data or for performance guarantees regarding the volume and speed of data transmissions. Users are responsible for taking all appropriate measures to protect their own data, software, equipment, and systems, particularly from contamination by any viruses circulating on the internet.

8. Indemnification

YOU AGREE TO DEFEND, INDEMNIFY AND HOLD US HARMLESS, AS WELL AS OUR AFFILIATES AND VENDORS AND RESPECTIVE DIRECTORS, OFFICERS, USERS AND AGENTS, FROM AND AGAINST ALL CLAIMS, SUITS, AND EXPENSES, INCLUDING ATTORNEYS’ FEES, ARISING OUT OF OR RELATED TO (A) YOUR USE OF THE WEBSITE AND/OR SERVICES; (B) YOUR NONCOMPLIANCE WITH OR BREACH OF THIS AGREEMENT; (C) YOUR USE OF THIRD-PARTY SERVICES, PRODUCTS, LINKS, ADVERTISEMENT, AND/OR TOOLS; (D) YOUR VIOLATIONS OF ANY THIRD-PARTY RIGHTS, INCLUDING THIRD-PARTY INTELLECTUAL PROPERTY RIGHTS; or (E) THE UNAUTHORIZED USE OF THE WEBSITE AND/OR SERVICES BY ANY OTHER PERSON USING YOUR INFORMATION.
